The Committee will be provided with the results of the judgement on appeal cases that went to Court.

EXEMPT INFORMATION

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 3 and 7 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Agreed that under Section 100A(4) of the Local Government Act 1972, to exclude the press and public from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraphs 3 and 7 of Part 1 Schedule 12a of the Act, as amended by the Freedom of Information Act 2000.

Agreed that the confidential minutes of the meeting held on 16 October 2014 are confirmed as a correct record.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - ARL (E3 AND E7)

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from ARL;

 

(c)

took the above report and all that was said by ARL into consideration.

 

The committee agreed to grant ARL’s application for a private hire driver’s licence subject to him completing the Topographical Knowledge of Plymouth test and the VRQ driver qualification in Transporting Passengers by Taxi and Private Hire or equivalent, within 12 months of receiving his licence.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - SM (E3 AND E7)

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from SM;

 

(c)

took the above report and all that was said by SM into consideration.

 

The committee agreed to grant ARL’s application for a private hire driver’s licence subject to him completing the Topographical Knowledge of Plymouth test and the VRQ driver qualification in Transporting Passengers by Taxi and Private Hire or equivalent, within 12 months of receiving his licence.  He must also provide sight of his DVLA Group 2 Medical Standards of Fitness to Drive certificate.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - IT (E3 AND E7)

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from IT;

 

(c)

took the above report and all that was said by IT into consideration.

 

The committee agreed that having taken the above into account to issue a warning which will remain on IT’s file indefinitely, and will be brought to the committee’s attention if he appears before them again.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - AP (E3 AND E7)

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from AP and his employer;

 

(c)

took the above report and all that was said by AP into consideration.

 

The committee agreed that having taken the above into account to revoke AP’s private hire driver’s licence under section 19(1)(b) of the Plymouth City Council Act 1975 as he is no longer considered to be a fit and proper person.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - DPT (E3 AND E7)

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from DPT;

 

(c)

took the above report and all that was said by DPT into consideration.

 

The committee agreed that having taken the above into account that -

 

(1)

DPT’s private hire driver’s licence is suspended for five days under Section 19(1)(b) of the Plymouth City Council Act 1975;

 

(2)

DPT is required to produce his NVQ/VRQ Level 2 certificate in Transporting Passengers by Taxi and Private Hire or equivalent within the next 7 days or he will be required to attend the next available committee.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - PAS (E3 AND E7)

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from PAS;

 

(c)

took the above report and all that was said by PAS into consideration.

 

The committee agreed that having taken the above into account no action would be taken against PAS’s private hire driver’s licence but a severe warning would be issued which would remain on file indefinitely and which would be brought to members’ attention if PAS appeared before them in the future.  Also PAS would be required to produce his VRQ Level 2 certificate in Transporting Passengers by Taxi and Private Hire or equivalent within the next 7 days or he would be required to attend the next available committee.
