APPEAL CASES

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

The committee was advised that a recent appeal against the committee’s decision had been withdrawn by the appellant.

EXEMPT INFORMATION

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 1, 2 and 3 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

APPLICATION FOR THE GRANT OF A HACKNEY CARRIAGE DRIVER'S LICENCE - AJW

The Director of Public Health will submit a report on an application for the grant of a hackney carriage driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from AJW;

 

(c)

took the above report and all that was said into consideration.

 

The committee agreed that having taken the above into account to grant AJW’s application for a hackney carriage driver’s licence subject to him producing a medical certificate confirming he is fit to Group II medical standards and also subject to him successfully completing the VRQ in Transporting Passengers by Taxi and Private Hire (or equivalent) within the first 12 months of being licensed.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - JR

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from JR;

 

(c)

took the above report and all that was said into consideration.

 

The committee agreed that having taken the above into account to grant JR’s application for a private hire driver’s licence subject to him successfully completing the VRQ in Transporting Passengers by Taxi and Private Hire (or equivalent) within the first 12 months of being licensed.

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

heard from JPT;

 

(c)

took the above report and all that was said into consideration.

 

The committee agreed that having taken the above into account to grant JPT’s application for a private hire driver’s licence subject to him completing his Driving Standards Test and producing a medical certificate confirming he is fit to Group II medical standards.  JPT is also required to successfully complete the VRQ in Transporting Passengers by Taxi and Private Hire (or equivalent) within the first 12 months of being licensed.

APPLICATION FOR THE GRANT OF A HACKNEY CARRIAGE DRIVER'S LICENCE - IJD

The Director of Public health will submit a report on an application for the grant of a hackney carriage driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from IJD;

 

(c)

took the above report and all that was said into consideration.

 

The committee agreed that having taken the above into account to grant IJD’s application for a hackney carriage driver’s licence subject to him completing all of the usual pre requisites.  IJD is also required to successfully complete the VRQ in Transporting Passengers by Taxi and Private Hire (or equivalent) within the first 12 months of being licensed.

With the permission of the Chair, the order of business was amended, as set out below in the minutes.

67.

REVIEW OF A HACKNEY CARRIAGE DRIVER'S LICENCE - LH

The Director of Public Health will submit a report on a hackney carriage driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from LH;

 

(c)

heard from LH’s legal representative;

 

(d)

took the above report and all that was said into consideration.

 

The committee agreed having taken the above into account that on this occasion no action would be taken against LH’s hackney carriage driver’s licence, however a warning would be placed on his file which would be brought to the committee’s attention if he appeared before them again.  Also in light of the medical information provided he is required to produce a medical certificate confirming he is fit to Group II medical standards; the certificate was to be produced to the Licensing Officer within the next 28 days.

68.

REVIEW OF A RESTRICTED PRIVATE HIRE DRIVER'S LICENCE - MAJU

The Director of Public Health will submit a report on a restricted private hire driver’s review of licence status.

Minutes:

This matter was not considered by the committee as they had been advised that MAJU had surrendered his licence.

69.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - TJD

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

TJD did not attend the committee and therefore the matter was adjourned to the next available committee date.  The committee requested that a letter be sent to TJD warning him that if he did not attend the next committee hearing the matter would be dealt with in his absence.
