APPEAL CASES

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

The Committee was advised that there had been no appeal cases since the last meeting.

EXEMPT INFORMATION

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 1, 2 and 3 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Agreed that the confidential minutes of the meetings held on 2 June 2016 and 14 July 2016 are confirmed as a correct record.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - AH

The Director of Public Health will submit a report on an application for the grant of a Private Hire driver’s licence.

Minutes:

The Committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from AH;

 

(c)

took the above report and all that was said into consideration.

 

The Committee agreed that having taken the above into account AH was not a fit and proper person to hold a Private Hire Driver’s Licence and therefore his application would be refused.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - KA

The Director of Public Health will submit a report on an application for the grant of a Private Hire driver’s licence.

Minutes:

The Committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from KA;

 

(c)

took the above report and all that was said into consideration.

 

The Committee agreed that having taken the above into account further information was required before they could consider the application, and once this had been received the matter should be brought back before the next available Committee.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - G-AA

The Director of Public Health will submit a report on an application for the grant of a Private Hire driver’s licence.

Minutes:

The Committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from G-AA;

 

(c)

took the above report and all that was said into consideration.

 

The Committee agreed that having taken the above into account G-AA was not a fit and proper person to hold a Private Hire Driver’s Licence and therefore his application would be refused.

35.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - AE

The Director of Public Health will submit a report on a Private Hire driver’s review of licence status.

Minutes:

The Committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from AE;

 

(c)

took the above report and all that was said into consideration.

 

The Committee agreed that having taken the above into account to suspend AE’s Private Hire Driver’s Licence for a period of 21 days under Section 19(1)(b) of the Plymouth City Council Act 1975.

36.

REVIEW OF A HACKNEY CARRIAGE DRIVER'S LICENCE AND PRIVATE HIRE DRIVER'S LICENCE - AD

The Director of Public Health will submit a report on a Hackney Carriage driver’s licence and Private Hire driver’s review of licence status.

Minutes:

The Licensing Officer advised the Committee that a request had been received from AD requesting an adjournment so that he can seek suitable legal representation. 

 

The Committee agreed to adjourn the hearing until the 25 August 2016.   If AD does not attend on that date, the matter would be dealt with in his absence.
