The Chair reminded Members of the additional meeting that had been arranged for 11 May 2017, and asked that Members confirm their attendance at their earliest opportunity.

Appeal Cases

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

Minutes:

The Committee was advised that there had been one appeal case since the last meeting;  however the driver had now surrendered his badge and the appeal was no longer going ahead.

Exempt information

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 1, 2 and 3 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Application for the Grant of a Private Hire Vehicle Driver's Licence - SAG

The Director of Public Health will submit a report on an application for the grant of Private Hire Vehicle Driver’s Licence.

Minutes:

The Committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from SAG;

 

(c)

took the above report and all that was said into consideration.

 

The Committee agreed that having taken the above into consideration, to grant SAG’s application for a Private Hire Vehicle Driver’s Licence subject to the completion of the Knowledge of Plymouth Test and the Driving Standards Test within 12 months of issue of the Licence and also subject to the condition to attend a Child Sexual Exploitation and Adult Safeguarding Course within the same period.

Application for the Grant of a Private Hire Driver's Licence - JH

The Director of Public Health will submit a report on an application for the grant of a Private Hire Driver’s Licence.

Minutes:

The Committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from JH;

 

(c)

took the above report and all that was said into consideration.

 

The Committee agreed that having taken the above into consideration, JH was not a fit and proper person to hold a Private Hire Driver’s Licence and therefore his application would be refused.

The Director of Public Health will submit a report on an application for the grant of a Private Hire Vehicle Driver’s Licence.

Minutes:

The Committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from MAC;

 

(c)

took the above report and all that was said into consideration.

 

The Committee agreed that having taken the above into account MAC was not a fit and proper person to hold a Private Hire Vehicle Driver’s Licence and therefore his application would be refused.

Review of a Hackney Carriage Driver's Licence - MD

The Director of Public Health will submit a report on a review of licence status.

Minutes:

The Committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from MD;

 

(c)

heard from a witness;

 

(d)

took the above report and all that was said into consideration.

 

The Committee agreed that having taken the above into consideration, to suspend MD’s Hackney Carriage Driver’s Licence for a period of 7 days under Section 19(1)(b) of the Plymouth City Council Act 1975.

126.

Review of a Private Hire Driver's Licence - CA

The Director of Public Health will submit a report on a review of licence status.

Minutes:

The Committee heard from the Licensing Officer that a letter had been sent to CA’s recorded address on 19 April 2017 inviting him to today’s hearing.  It was set out within the letter in bold that if he failed to attend the hearing may proceed in his absence.  It was also noted that the Licensing Officer had attempted to telephone him to confirm his attendance and had left a voicemail message for him.

 

The Committee determined to proceed in his absence given CA’s failure to complete the pre-requisite course and as he is driving members of the public.

 

The Committee -

 

(a)

considered the report from the Director of Public Health;

 

(c)

took the above report and all that was said by the Licensing Officer into consideration.

 

The Committee agreed that having taken the above into consideration, to revoke CA’s Private Hire Driver’s Licence under Section 19(1)(b) of the Plymouth City Council Act 1974 as he is no longer considered to be a fit and proper person.
