Appeal Cases

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

Members were updated on an Appeal Case that was due to be heard had been adjourned until the New Year.

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 1 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Agreed that under Section 100A(4) of the Local Government Acct 1972 to exclude the press and public from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Review Status of Private Hire Vehicle Driver Licence - DPT

The Director of Public Health will submit a report to Review Status of Private Hire Vehicle Driver Licence – DPT.

Minutes:

The Committee –

 

(a)        considered and took into account the report from the Director of Public Health;

 

(b)        heard from DPT;

 

(c)        took all of the above and the report into consideration and also considered the Council’s Hackney Carriage and Private Hire Licensing Policy 2018;

 

The Committee –

 

Agreed the suspension of DPT’s private hire driver’s licence for a period of 21 days in accordance with section 19(1)(b) of the Plymouth City Council Act 1975. In addition to this, and in accordance with the Council’s policy at Chapter 5 paragraph 3.3, DPT is required to undertake further training and must therefore re take and pass his Driving Standards Test, successfully complete the Council’s Safeguarding training and successfully complete the Plymouth Ambassador Training. DPT must attend the next available course in respect of all of the above.

Application for the Grant of a Private Hire Vehicle Driver Licence - BG

The Director of Public Health will submit a report on the Application for the Grant of a Private Hire Vehicle Driver Licence.

Minutes:

The Committee –

 

(a)        considered and took into account the report from the Director of Public Health;

 

(b)        heard from BG and the Licensing Officer;

 

(c)        took all of the above and the report into consideration and also considered the Council’s Hackney Carriage and Private Hire Licensing Policy 2018;

 

The Committee -

 

Agreed to grant BG’s application for a private hire driver’s licence subject to him successfully completing the VRQ in transporting passengers by taxi and private hire or equivalent within the first 12 months of being licensed and further to attend and successfully complete the next available Safeguarding course and Plymouth Ambassadors course.
