Members agreed the minutes of the 20 February 2020 as an accurate record of the meeting subject to the following change:

 

Minute 70 ‘Exempt Information’ should refer to section 100(4) of the Local Government Act.

Appeal Cases

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

Members were advised of a recent appeal that went to the Magistrates court and was successfully defended by the Council.

Exempt Information

To consider passing a resolution under Section 100A(4) of the Local Government Act, 1972 to exclude the press and the public from the meeting for the following items of business, on the grounds that they involve the likely disclosure of exempt information, as defined in paragraph 1 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Agreed that under Section 100(4) of the Local Government Act 1972, to exclude the press and public from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information, as defined in paragraph 1 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

The Committee agreed that the confidential minutes of the meeting held on 20 February 2020 were an accurate record.

 

82.

Review Status of a Hackney Carriage Vehicle Driver Licence

The Director of Public Health will submit a report on the review status of a hackney carriage vehicle driver licence.

Minutes:

The Committee –

 

(a)

considered and took into account the report from the Director of Public Health;

 

(b)

heard from the applicant;

 

(c)

heard from the licensing officer;

 

(d)

took into account all that was said by the taxi driver, all relevant policies referred to in the report, the fact that the taxi driver wasn’t acting in the course of his employment when the incident occurred;

 

(e)

considered the review on its own merits whilst considering relevant licensing objectives of Safety and Health of Drivers and the Public, Vehicle Safety, Prevention of Crime and Disorder and the Protection of Consumers in the Council’s policy.

 

The Committee asked themselves the question, set out in the Council’s policy, as to whether they would allow someone they cared about or a vulnerable person to get into a vehicle driven by this individual, and the answer was no.

 

Members agreed that this driver was no longer considered to be a fit and proper person and that the licence would be revoked in accordance with Section 19 Plymouth City Council Act 1975 on the grounds of being convicted of an offence involving violence and “any other reasonable cause”.

The Director of Public Health will submit a report on the application for the grant of a Private Hire Vehicle Driver’s Licence.

Members did not consider this application and it was therefore adjourned to a future meeting of the Taxi Licensing Committee.
