Exempt Information To consider passing a resolution under Section 100A(4) of the Local Government Act, 1972 to exclude the press and the public from the meeting for the following items of business, on the grounds that it (they) involve(s) the likely disclosure of exempt information, as defined in paragraph(s) (1,2,3,4,5,6,7) of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000. Minutes: The Committee agreed to pass a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and the public from the meeting for the following items of business, on the grounds that they involve the likely disclosure of exempt information, as defined in paragraph 1 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000. |

Review Status of a Hackney Carriage Vehicle Driver Licence Minutes: The Committee:
a)
Considered all that was said by the driver; b)
Considered all of the information contained within the
report; c)
Considered all of the relevant policies referred to in the
report; d)
Asked itself whether it would want a person they cared for or a
vulnerable person to be driven in a vehicle driven by the
driver. The Committee agreed to:
1.
The driver’s Hackney Carriage Vehicle Licence would be
suspended until such time as the vehicle had received an MOT and
the certificate was presented to the Licencing Office and a warning
letter would be issued; 2. The driver’s Hackney Carriage Driver’s Licence would be suspended for 30 days under s19 (1) Plymouth City Council Act 1975 for ‘any reasonable cause’ and a warning letter would be issued. |

Review Status of a Hackney Carriage Driver Licence Minutes: The Committee:
a)
Considered all that was said by the driver; b)
Considered all of the information contained within the
report; c)
Considered all of the relevant policies referred to in the
report; Asked itself whether it would want a person they cared for or a vulnerable person to be driven in a vehicle driven by the driver.
The Committee agreed to:
1.
Allow the driver to retain his Hackney Carriage Vehicle Licence and
no further action would be taken in respect of this licence under
s18(1) (c) Plymouth City Council Act 1975; 2.
Elected to revoke the driver’s Hackney Carriage
Driver’s Licence ‘for any other reasonable cause’
under s19(1) (b) Plymouth City Council Act 1975 as they no longer
consider the driver to be a fit and proper person to hold a Hackney
Carriage Driver’s Licence. |
