APPEAL CASES

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

The committee was advised that there had been no new appeal cases since the last meeting.

EXEMPT INFORMATION

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 3 and 7 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Agreed that under Section 100A(4) of the Local Government Act 1972, to exclude the press and public from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraphs 3 and 7 of Part I Schedule 12a of the Act, as amended by the Freedom of Information Act 2000.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE OPERATOR'S LICENCE - GP (E3 AND E7)

The Strategic Director for People will submit a report on an application for the grant of a private hire operator’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Strategic Director for People;

 

(b)

heard from GP.

 

The committee having taken the above items into account agreed to grant GP’s application for a private hire operator’s licence.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - MS (E3 AND E7)

The Strategic Director for People will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Strategic Director for People;

 

(b)

heard from MS;

 

(c)

took the above report and all that was said by MS into consideration.

 

The committee agreed that having taken the above into account to suspend MS’s private hire driver’s licence for a period of three days under Section 19(1)(b) of Plymouth City Council Act 1975.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - AR (E3 AND E7)

The Strategic Director for People will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Strategic Director for People;

 

(b)

heard from AR.

 

The committee agreed to grant AR’s application for a private hire driver’s licence subject to AR completing any remaining prerequisites, and also the VRQ driver qualification in Transporting Passengers by Taxi and Private Hire or equivalent within the first 12 months of being licensed.

102.

REVIEW OF A HACKNEY CARRIAGE DRIVER'S LICENCE - GM (E3 AND 37)

The Strategic Director for People will submit a report on a hackney carriage driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Strategic Director for People;

 

(b)

heard from a witness;

 

(c)

heard from GM;

 

(d)

took the above report and all that was said by both parties into consideration.

 

The committee agreed that having taken the above into account GM’s Hackney Carriage driver’s licence is suspended for a period of five days under Section 19(1)(b) of Plymouth City Council Act 1975,  and he will be required to pass the VRQ in Transporting Passengers by Taxi and Private Hire or equivalent within the next 12 months.

The Strategic Director for People will submit a report on an application for the grant of a private hire driver’s licence.

considered the report from the Strategic Director for People;

 

(b)

heard from SA

 

(c)

took the above report and all that was said by SA into consideration.

 

The committee agreed that the application for the grant of a private hire driver’s licence is refused.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - VB (E3 AND 37)

The Strategic Director for People will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The Licensing Officer advised the committee that VB had withdrawn his application for a private hire driver’s licence.
