APPEAL CASES

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

The committee was advised that there had been no new appeal cases since the last meeting.

EXEMPT INFORMATION

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 3 and 7 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - MN (E3 AND E7)

The Strategic Director for People will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee -

 

(a)

considered the report from the Strategic Director for People;

 

(b)

heard from MN and his operator.

 

The committee agreed to grant MN’s application for a private hire driver’s licence subject to him completing the VRQ qualification in Transporting Passengers by Taxi and Private Hire or equivalent within the first 12 months of any licence issued to him.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - AS (E3 AND E7)

The Strategic Director for People will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Strategic Director for People;

 

(b)

heard from AS;

 

(c)

took the above report and all that was said by AS into consideration.

 

The committee agreed to issue AS with a warning.  This warning will remain on file indefinitely and will be brought to committee’s attention if AS appears before it again in the future.  Further, due to the committee’s concerns for public safety AS is required to complete the private hire/hackney carriage driving test within the next three months.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - JA (E3 AND E7)

The Strategic Director for People will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Strategic Director for People;

 

(b)

heard from JA.

 

The committee agreed to grant JA’s application for a private hire driver’s licence subject to JA satisfactorily completing all the pre requisites for the grant of a licence, namely the Knowledge of Plymouth Test, the Driving Standards Test, and Group 11 DVLA medical certificate, and subject to him completing the VRQ qualification in Transporting Passengers by Taxi and Private Hire or equivalent within 12 months of any licence issued to him.

 

Order of business

 

With the permission of the Chair, the order of business was amended, as set out below in the minutes.

REVIEW OF A PRIVATE HIRE DRIVERS LICENCE - TP (E3 AND E7)

The Strategic Director for People will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Strategic Director for People;

 

(b)

heard from TP;

 

(c)

took the above report and all that was said by TP into consideration.

 

The committee agreed that having taken the above into account to suspend TP’s private hire driver’s licence for five days in total under Section 19(1)(b) Plymouth City Council Act 1975.

The Strategic Director for People will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee -

considered the report from the Strategic Director for People;

heard from RM;

 

(c)

took the above report and all that was said by RM into consideration.

 

The committee agreed that having taken the above into account to take no further action.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - AP (E3 AND E7)

The Strategic Director for People will submit a report on a private hire driver’s review of licence status.

Minutes:

Due to concerns regarding AP’s English comprehension, it was agreed that this hearing is adjourned until the next available committee date when AP would be accompanied by a translator to ensure that a fair hearing could take place.
