APPEAL CASES

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

The committee was advised that there had been no appeal cases since the last meeting.

EXEMPT INFORMATION

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 3 and 7 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Agreed that under Section 100A(4) of the Local Government Act 1972, to exclude the press and public from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraphs 3 and 7 of Part 1 Schedule 12a of the Act, as amended by the Freedom of Information Act 2000.

Agreed that the confidential minutes of the meeting held on 12 June 2014 are confirmed as a correct record.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - GG (E3 AND E7)

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from GG;

 

(c)

took the above report and all that was said by GG into consideration.

The committee agreed to grant GG’s application for a private hire driver’s licence subject to the production of a DVLA Group 11 medical certificate.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - RK (E3 AND E7)

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from RK;

 

(c)

took the above report and all that was said by RK into consideration.

The committee agreed to grant RK’s application for a private hire driver’s licence subject to the production of a DVLA Group 11 medical certificate.

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

considered the report from the Director of Public Health;

 

(b)

heard from MD;

 

(c)

took the above report and all that was said by MD into consideration.

The committee agreed to grant MD’s application for a private hire driver’s licence.

 

 

23.

REVIEW OF A HACKNEY CARRIAGE DRIVER'S LICENCE - AVB (E3 AND E7)

The Director of Public Health will submit a report on a hackney carriage driver’s review of licence status.

Minutes:

The committee -

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from AVB;

 

(c)

took the above report and all that was said by AVB into consideration.

The committee agreed that –

 

(1)

having taken the above into account to suspend AVB’s hackney carriage driver’s licence for four days in total under Section 19(1)(b) of the Plymouth City Council Act 1975;

 

(2)

AVB is required to obtain the Level 2 VRQ in Transporting Passengers by Taxi and Private Hire or equivalent within the next 12 months.

24.

REVIEW OF A HACKNEY CARRIAGE DRIVER'S LICENCE - DD (E3 AND E7)

The Director of Public Health will submit a report on a hackney carriage driver’s review of licence status.

Minutes:

The committee -

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from DD;

 

(c)

took the above report and all that was said by DD into consideration.

The committee agreed that –

 

(1)

having taken the above into account to suspend DD’s hackney carriage driver’s licence for seven days in total under Section 19(1)(b) of the Plymouth City Council Act 1975;

 

(2)

DD is required to complete the Level 2 VRQ in Transporting Passengers by Taxi and Private Hire or equivalent within the next 12 months;

 

(3)

DD’s probationary period will be reinstated for a period 12 months.

25.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - PG (E3 AND E7)

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee -

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from PG;

 

(c)

took the above report and all that was said by PG into consideration.

The committee agreed that –

 

(1)

having taken the above into account to suspend PG’s private hire driver’s licence for seven days under Section 19(1)(b) of the Plymouth City Council Act 1975;

 

(2)

PG is required to resit the driving standards test within the next six months;

 

(3)

PG’s probationary period will be reinstated for a period of 12 months.
