APPEAL CASES

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

The committee was advised that there had been no appeal cases since the last meeting.

EXEMPT INFORMATION

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 3 and 7 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Agreed that under Section 100A(4) of the Local Government Act 1972, to exclude the press and public from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraphs 3 and 7 of Part 1 Schedule 12a of the Act, as amended by the Freedom of Information Act 2000.

To confirm the confidential minutes of the meeting held on 26 June 2014.

Agreed that the confidential minutes of the meeting held on 26 June 2014 are confirmed as a correct record.

32.

APPLICATION FOR THE GRANT OF A HACKNEY CARRIAGE DRIVER'S LICENCE - ABA (E3 AND E7)

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from ABA;

 

(c)

took the above report and all that was said by ABA into consideration and had sight of a reference from his employer.

The committee agreed to grant ABA’s application for a hackney carriage driver’s licence subject to satisfactorily completing the remaining pre-requisites for the grant of a licence, being the Driving Standards Test, the Knowledge of Plymouth Test and the production of a DVLA Group 11 medical certificate and subject to him completing the Level 2 VRQ in Transporting Passengers by Taxi and Private Hire or equivalent within the first 12 months of any licence issued to him.

With the permission of the chair, the order of business was amended, as set out below in the minutes.

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from WVM;

 

(c)

took the above report and all that was said by WVM into consideration.

The committee agreed to grant WVM’s application for a private hire driver’s licence subject to satisfactorily completing the remaining pre-requisites for the grant of a licence, being the Knowledge of Plymouth Test, the Driving Standards Test and the production of a DVLA Group 11 medical certificate.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - ALF (E3 AND E7)

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from ALF;

 

(c)

took the above report and all that was said by ALF into consideration.

The committee agreed that having taken the above into account to suspend ALF’s private hire driver’s licence for two days in total under Section 19(1)(b) of the Plymouth City Council Act 1975.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - LS (E3 AND E7)

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from LS;

 

(c)

took the above report and all that was said by LS into consideration and heard representations from his employer.

The committee agreed that having taken the above into account to suspend LS’s private hire driver’s licence for two days in total under Section 19(1)(b) of the Plymouth City Council Act 1975.

36.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - LCT (E3 AND E7)

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee was advised that LCT was not present due to urgent family business.  It was agreed that the Licensing Officer would write to LCT and advise him to attend the next available committee.

37.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - CS (E3 AND 37)

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

Due to CS’s non-attendance at this meeting, the committee agreed to hear the case in his absence and -

 

(a)

considered the report from the Director of Public Health;

 

(b)

took the above report into consideration.

 

The committee agreed that having taken the above into account to revoke CS’s private hire driver’s licence under section 19(1)(b) of the Plymouth City Council Act 1975 as he is no longer considered to be a fit and proper person.

38.

REVIEW OF A HACKNEY CARRIAGE DRIVER'S LICENCE - RRTL (E3 AND E7)

The Director of Public Health will submit a report on a hackney carriage driver’s review of licence status.

Minutes:

Due to RRTL’s non-attendance at this meeting, the committee agreed to hear the case in his absence and -

 

(a)

considered the report from the Director of Public Health;

 

(b)

took the above report into consideration.

The committee agreed that having taken the above into consideration to suspend RRTL’s Hackney Carriage Driver’s Licence for seven days in total under Section 19(1)(b) of the Plymouth City Council Act 1975.

39.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - WAF (E3 AND E7)

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from WAF;

 

(c)

took the above report and all that was said by WAF into consideration.

The committee agreed that -

 

(1)

having taken the above into account to suspend WAF’s private hire driver’s licence for five days in total under section 19(1)(b) of the Plymouth City Council Act;

 

(2)

WAF’s probationary period as a driver will be extended for a further 12 months.
