APPEAL CASES

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

The committee was advised that there had been no appeal cases since the last meeting.

EXEMPT INFORMATION

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 1, 2 and 3 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Agreed that under Section 100A(4) of the Local Government Act 1972, to exclude the press and public from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraphs 1, 2 and 3 of Part 1 Schedule 12a of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Under this agenda item, Councillor Bowie asked the Licensing Officer a question relating to the issuing of Private Hire and Hackney Carriage Licences.  She was subsequently informed by the Legal Officer that she would advise her on this matter outside of the meeting.

APPLICATION FOR THE GRANT OF A PRIVATE HIRE DRIVER'S LICENCE - MAC

The Director of Public Health will submit a report on an application for the grant of a private hire driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from MAC;

 

(c)

took the above report and all that was said into consideration.

 

The committee agreed to grant MAC’s application for a private hire driver’s licence subject to him completing the Knowledge of Plymouth Test and the Driving Standards Test.  In addition he is required to complete the VRQ in Transporting Passengers by Taxi and Private Hire or equivalent within the first 12 months of his licence being granted.

 

41.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - MP

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee agreed to adjourn this case to the next committee hearing as MP did not attend.  A letter is to be sent to MP advising him that the matter will be dealt with at the next committee and if he fails to attend the matter will be dealt with in his absence.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - RJW

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from RJW;

 

(c)

heard from RJW’s representative;

 

(d)

took the above report and all that was said into consideration.

 

The committee agreed that having taken the above into account to suspend RJW’s private hire licence for a period of 3 days under Section 19(1)(b) of the Plymouth City Council Act 1975.  In addition he would be required to successfully complete the VRQ in Transporting Passengers by Taxi and Private Hire or equivalent within the next 12 months.

REVIEW OF A PRIVATE HIRE DRIVER'S LICENCE - DMT

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from DMT;

 

(c)

took the above report and all that was said into consideration.

 

The committee agreed that having taken the above into account to suspend DMT’s private hire driver’s licence for 5 days under section 19(1)(b) of the Plymouth City Council Act 1975.  In addition he would be required to successfully complete the VRQ in Transporting Passengers by Taxi and Private Hire or equivalent within the next 12 months.
