The Committee will be asked to note the appointment of the Chair and Vice Chair for the municipal year 2016-2017.

The committee noted the appointment of Councillor Kelly as Chair, and Councillor Ken Foster as Vice Chair.

There were no items of Chair’s urgent business.

APPEAL CASES

The Committee will be provided with the results of the judgement on appeal cases that went to Court.

Minutes:

One appeal had been expected to go before the Court since the last meeting. That appeal was dismissed as the applicant failed to pay their Court fees.

6.

EXEMPT INFORMATION

To consider passing a resolution under Section 100A(4) of the Local Government Act 1972 to exclude the press and public from the meeting for the following item(s) of business on the grounds that it (they) involve(s) the likely disclosure of exempt information as defined in paragraph(s) 1, 2 & 3 of Part 1 of Schedule 12A of the Act, as amended by the Freedom of Information Act 2000.

Minutes:

Agreed that under Section 100A(4) of the Local Government Act 1972, to exclude the press and public from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraphs 1, 2 and 3 of Part 1 Schedule 12a of the Act, as amended by the Freedom of Information Act 2000.

8.

Application for the grant of a private hire vehicle driver's licence - DF

The Director of Public Health will submit a report on an application for the grant of a private hire vehicle driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from DF and his representatives;

 

 

(c)

took the above report and all that was said into consideration.

 

 

The committee agreed that having taken the above into account it would refuse DF’s application for a Private Hire Driver’s Licence under section 19(1)(b) of the Plymouth City Council Act 1975 as the committee did not consider him to be a fit and proper person to hold such a licence.

 

9.

Application for the grant of a private hire vehicle driver's licence - G-AA

The Director of Public Health will submit a report on an application for the grant of a private hire vehicle driver’s licence.

Minutes:

The committee heard that G-AA was not in attendance and agreed that the matter would be adjourned until he confirmed that he wished the application to be dealt with.

Application for the grant of a private hire vehicle driver's licence -PJG

The Director of Public Health will submit a report on an application for the grant of a private hire vehicle driver’s licence.

The committee heard that PJG was not in attendance and agreed that the matter would be adjourned until he confirmed that he wished the application to be dealt with.

Application for the grant of a private hire vehicle driver's licence - JH

The Director of Public Health will submit a report on an application for the grant of a private hire vehicle driver’s licence.

Minutes:

The committee –

 

(a)

considered the report from the Director of Public Health;

 

(b)

heard from JH and his wife;

 

 

(c)

took the above report and all that was said into consideration.

 

The committee agreed to grant JH’s application for a private hire vehicle driver’s licence subject to him producing a DVLA Group 2 medical certificate and subject to him completing the VRQ in transporting passengers by taxi and private hire within the first 12 months of being licensed. JH will be excused from sitting both the Topographical Knowledge of Plymouth Test and the Driving Standards Test.

12.

Review of a Hackney Carriage driver's licence - AL

The Director of Public Health will submit a report on a private hire driver’s review of licence status.

Minutes:

The committee:

 

(a)   was advised that AL had indicated to the Licensing officers that he would not be attending and wished the matter heard in his absence;

 

(b)  considered the report from the Director of Public Health;

 

(c)   took into account the report and all that was said.

 

The committee agreed, having taken the above into account, to revoke AL’s Hackney Carriage Driver’s Licence under section 19(1)(b) of the Plymouth City Council Act 1975 as he is no longer considered to be a fit and proper person.
