Consultation process

A Leaseholder Guide to the stock transfer proposal has been drafted.  This will be circulated to all leaseholders at the same time as the Formal Offer Document is sent to the Council’s secure and introductory tenants.

 

Leaseholders will be encouraged to feedback to the Council on the contents of the Guide.  The Council will consider any comments tenants and leaseholders make on the proposal.

Whilst there is no legal requirement to formally consult leaseholders on the stock transfer proposal, it is considered good practice to do so.

 

The law which states that Councils have to consult their tenants about proposed transfers of Council housing is set out in Section 106A and schedule 3A of the Housing Act 1985.  The Council and the Secretary of State must have regard to the views of the Council’s secure and introductory tenants.

Information to be considered by the decision makers: The Leaseholders Guide will be sent to all leaseholders. This document includes a tear off slip for comments. Comments received will be considered and may result in changes being made to the formal proposal.
