To receive reports on business which, in the opinion of the Chair, should be brought forward for urgent consideration.

Minutes:

With the permission of the Chair, the Director of Development drew the Committee’s attention to the need to postpone Member training on the Local Development Framework planned for 4 February, 2005.

 

Resolved that Member training on the Local Development Framework be re-scheduled if considered necessary following the Member seminar on the LDF in March 2005.

 

(In accordance with Section 100 (B) (4) (b) of the Local Government Act, 1972, the Chair brought forward the above item for consideration because of the need to inform Members and seek a decision.)

The Head of Planning and Regeneration will submit a schedule asking Members to consider Applications, Development proposals by Local Authorities and statutory consultations under the Town and Country Planning Act 1990 and the Planning (Listed Building and Conservation Areas) Act 1990.

 

The Chair will inform the Committee of those Ward Members and/or members of the public wishing to speak.

The Director of Development acting under powers delegated to him by the Council will submit a schedule outlining all decisions issued from 24th December, 2004-18th January, 2005, including –

2)  Delegated decisions, subject to conditions where so indicated;

3)  Applications withdrawn;

4)  Applications returned as Invalid.

 

Please note that the Delegated Planning Applications are available for inspection at First Stop Reception, Civic Centre.

Minutes:

The Committee -

 

(i)

received a report (P47 04/05) of the Director of Development on matters dealt with by him under delegated powers;

 

(ii)

heard from Councillor Michael Leaves on his concern at what he perceived to be a lack of consistency in the decisions taken in respect of two similar applications (04/02125 and 04/02145).

 

Resolved that –

 

(1)

the report be noted;

 

(2)

with regard to (ii) above, the Director of Development provide Councillor Michael Leaves with a detailed response.

The Committee received a schedule of decisions made by the Planning Inspectorate on appeals arising from the decisions of the City Council (P48 04/05).

 

Resolved that the schedule be noted.

The Director of Development will present a report outlining the results of a review of the Scheme of Delegation in respect of planning applications, introduced on the 1st January, 2004, and associated Planning performance.

The Director of Development presented a report (P49 04/05) outlining the results of a review of the Scheme of Delegation in respect of planning applications introduced on 1 January 2004, and associated planning performance.

 

The Chair took the opportunity to thank the Committee and the Department for the work carried out over the last year to achieve the significant improvement in performance.

 

Resolved that –

 

(1)

the report be noted with thanks;

 

(2)

the Scheme of Delegation be retained and Officers be instructed to review the scheme on a yearly basis;

 

(3)

Officers be instructed to promote the Scheme of Delegation with the Planning Officers Society as an example of Best Practice;

 

(4)

 

the annual report be placed on future Council Agendas.

EXCLUSION OF THE PRESS AND PUBLIC

Minutes:

Resolved that under Section 100 (a) (4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following item on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 13 of Part 1 of Schedule 12A of the Act.

The Director of Development presented a report (P50 04/05) on an enforcement issue concerning the above.

 

Resolved that an enforcement notice be issued seeking the removal of the box dormer subject to the Head of Legal Services being satisfied as to the legal aspects of the case.
