The Committee will consider an application for an Order under section 53 of the Wildlife and Countryside Act 1981 to modify the definitive map and statement of public rights of way by the addition of three lengths of public footpath in St Budeaux.

The Strategic Director for Place submitted a report outlining proposals for an Order, under section 53 of the Wildlife and Countryside Act 1981, to modify the definitive map and statement of public rights of way by the additional of three lengths of public footpath in St Budeaux.

 

The Committee was satisfied that the evidence submitted by the applicant was robust enough to support the view that public rights of way subsist, or could be reasonably alleged to subsist, and therefore AGREED to make a Modification Order in respect of the middle section (between Normandy Hill and Wolseley Road) only of the public footpath, as detailed in the report.
